The meeting was called to order at 9:00 a.m. by Chairperson John A. Bolender by leading the Pledge of Allegiance. Commissioners Mary Jo Cady and Cynthia D. Olsen were in attendance.

Economic Development Council commented on the influence of the Comprehensive Plan "Matrix" on the local business development. (copy to Planning)

Information received from the City of Forks regarding the development of an organization for rural Washington, The Other Washington Network, aka T.O.W.N.

Received a copy of the Port of Dewatto's Comprehensive Plan 2000.

Mason Conservation District is hosting a meeting to facilitate obtaining the rankings and necessary signatures for the local prioritization process for Centennial Grant applications. They are requesting either attendance or a "have no objection" letter from the organizations involved.

Cmmr. Bolender stated he has received a proposal from the Economic Development Council regarding the identification of commercial and industry land in Mason County with regard to rural activity centers.

Kristen Gilliland, Peste Child Care Center, read aloud the proclamation for the Week of the Young Child.

Request the Chair sign the internet on-line ordering system agreement with the State of Washington, Department of General Administration, authorizing Diane Zoren to order office supplies on-line with Central Stores.

Parks and Recreation Department is requesting the Board approve the following agreements for concession sales:

Thomas Roberts, $301.60 utilities; $100 rent = $401.60 ($1.60 from emergency funds)

MCFPD #17 have named Nadine Jackson as their representative and Edie Hicks as alternate to the Mason County EMS Council.

Cmmr. Bolender stated the Washington State Legislature has proposed budgets that will substantially reinstate revenue that Mason County lost due to I-695. Based on that he presented a resolution to repeal Resolution No. 157-99 which eliminates the extra closure days for Mason County.

Cmmr. Bolender noted they are not restoring extra help or overtime due to budget constraints.

The Board recessed for 10 minutes.

Shandra O'Haleck, Planning, presented the staff report. The project consists of boring a new 12" pipeline beneath Goldsborough Creek to replace an 8" exposed pipeline. The new pipeline will be located approximately 15 feet below the streambed of Goldsborough. The new pipeline will be cut and tied into an existing pipeline that is a main line serving the Kitsap Peninsula.

The proposal appears to be consistent with Utilities Chapter 7.16.090 of the Mason County Shoreline Master Program. Staff recommends approval of the permit with the following conditions:

1. The applicant shall comply with the specifications and conditions of the Washington Department of Fish and Wildlife Hydraulic Project Approval issued for this project.

2. A US Army Corps of Engineers Permit or Exemption and a WA State Water Quality Certification may be required prior to construction.

3. The project area shall be replanted with native species and provided with maintenance care until the newly planted area is established.

4. The applicant shall implement temporary erosion control measures (silt fencing, matting, and straw bales) during construction.

5. Debris or deleterious material resulting from construction shall be removed from the shoreline area and project site and shall not be allowed to enter waters of the State.

6. The proposed project must be consistent with all applicable policies and other provisions of the Shoreline Management Act, its rules, and the Mason County Shoreline Master Program.

7. Applicant shall amend the Goldsborough Creek Revetment Contingency Plan, dated August 1997 to include worst case scenario, the first responders and their roles, and how adjacent landowners would be notified in case of an emergency.

Cmmr. Cady asked about odorization of natural gas. She asked why there is no smell until you get to the Burger Master area.

Ms. O'Haleck responded she has talked to Joe Subsits at Washington Utilities & Transportation Commission who stated he will investigate that, it should be odorized at all points.

Cmmr. Cady asked about design specifications.

Ms. O'Haleck stated CFR is Code of Federal Regulations and there are design specifications in Part 192. Specific minimum yield strength ensures a strong pipe and it is not in the regulations but it is a preferred condition, 20% is the standard.

Cmmr. Cady then asked about the pipe going from 8" to 12" and going beneath the stream bed. She asked what happens at the connections. She also asked why this wasn't done under an emergency permit.

Ms. O'Haleck stated she understood it wasn't done under the emergency permit because there was a difficulty in securing an easement. She referred the other questions to the applicant.

John Hubler, Cascade Natural Gas, explained they are going to a 12" pipe for additional capacity. He explained, in detail, the precautions they take to ensure safety.

Cmmr Cady asked about shut off valves.

Mr. Hubler responded there will be two new shut off valves installed on both sides of the creek. Currently, there is a shut off valve at Shelton-Matlock Road and at Burgermaster. He explained the quality control checks of the pipes. There is an odorization station on Deegan Road. This project should take about two weeks with no planned disruption of service.

Cmmr. Olsen asked that an eighth condition be added regarding the design specifications. The condition would state the design specifications for this project are required to comply with 49 CFR (Code of Federal Regulations) part 192. In addition, 1) 100% radiographs shall be performed on all welds; 2) The line will be hydro tested; 3) Specified minimum yield strength (SMYS) will be 20%.

Pam Bennett-Cumming, Planning, presented the staff report. The request is an extension of Preliminary Plat Approval, Clifton Ridge (formerly known as Hood Canal Heights), #PLT95-0003. Clifton Ridge was granted preliminary plat approval (as Hood Canal Heights) on March 26, 1996 for a total of 24 residential lots and two undeveloped tracts, and open space. The original completion date of the final plat was 3-26-99 and a one year administrative extension was made to 3-26-2000.

The County has reviewed the progress that has been made by the applicant to submit Clifton Ridge for final plat approval and has determined a good faith effort has been made. The applicant has stated his intent is to complete the process as soon as possible. The extension will expire on 3-26-2001.

Rick Krueger, project sponsor, stated everything has been turned in to the Planning Department for final approval and hopes to have it finalized in a few weeks.

Allan Borden, Planning, presented the staff report. The proposal is a revised application for a shoreline variance to construct a residence and garage on a property along Hood Canal.

A previous application for a shoreline and side yard setback variance to locate a new residence and garage was denied by the Board of Mason County Commissioners on 10-5-99. The applicant has since revised their development proposal and site plan and the project description is a shoreline variance to construct a 53 foot wide by 33 foot deep (1750 square foot area) one-story residence; the variance requested is for the side yard setback to 1 foot 9 inches for the house roof overhang. (Urban Shoreline Environment side yard setback is 5 feet).

As proposed, the location of the residence building is inconsistent with the criteria of Chapter 7.16.080 (Residential Development), as the location does not meet the side yard setback standards along the Urban Shoreline Environment. With the site plan and application information provided, the proposal does meet Chapter 7.28.020 (Variances) five criteria. Staff finds the proposal consistent with the Variance criteria, subject to the conditions listed below:

1. All portions of the proposed structures, including roof overhangs, shall be located on the subject property as shown on the revised site plan (at the 1 foot 9 inches property line setback distance at the rear east corner) as reviewed in this shoreline permit.

2. The applicant shall comply with the policies and regulations of the Shoreline Management Act, Mason County Shoreline Master Program, Mason County Building Department, and Mason County Health Department.

3. The applicant shall acknowledge a specific condition on the building permit for the subject residence relating to adequate fire protection: a) the applicant shall provide a fire restrictive wall along the east side of the structure to provide fire protection; or b) the neighboring property owner to the east shall maintain a 10 foot building separation from any portion of a structure constructed to the roof line of the residence proposed in this shoreline permit.

Cmmr. Cady believes condition 3 should be deleted. The easement that has been granted demonstrates the property owners have been in discussions and are taking responsibilities for the setback.

The Board discussed the encroachment on the easement.

Skip Wright, Human Resources, requested a resolution, amending Resolution No. 127-98 to amend the Deputy Prosecutors salary plan, be adopted by the Board.

Carolyn Dietzman, Health Department, requested the Board approve a grant application for the Access to Baby and Child Dentistry (ABCD) Program. Total funding is $47,350; Medicaid Administrative Match, $18,550; Washington Dental Service Foundation, $21,300; and in-kind, $7,500.

Cmmr. Cady voiced her support of fluoride for those that want it.

Rich Geiger, Public Works, requested authorization to advertise for bids to supply Mason County with mineral aggregate materials for 2000.

Mr. Geiger requested the Board increase the primary representation on the TIP - CAP to twelve individuals rather than nine.

Mr. Geiger requested the Board authorize the closure of Clifton Lane to accommodate the Belfair Summerfest. This will be from 5:00 p.m. June 23 to 9:00 p.m. June 25.

Ione Siegler, Budget Director, requested the Board set a hearing to consider a supplemental appropriation to Current Expense and the Capital Improvement Fund.

Dave Salzer, Planning, requested the Board grant authorization to post and then advertise, if necessary, for a Senior Planner IV to fill a position that will be vacated.

Mr. Yando recommended to award the bid for painting the solid waste buildings to Todd Robinson Painting of Lacey, in the amount of $25,961

It was noted there will be a workshop on Monday, April 10 at 3:00 p.m. to 5:00 p.m. in the Commission Chambers and if the April 4th hearing is continued, it will be on Tuesday, April 18, location to be determined.
